Legal Question in Landlord & Tenant Law in Florida

my father passed away in the stste of fla. Leaving a notarized will making me beneficiary oof his mobile home and land it is not paid off yet but the lein holder has no problem putting it in my name my handicapped brother lives there and will continue to do so the rest of his life. I want to have the title changed to my name without going to probate court because of the cost involved, there is only myself and brother this is in the stste of fla. please advise

Depending on the value of it, you may be able to do a summary administration, which is substantially less expensive than a full probate.

To get the name changed to yours on the title, you have to go through probate. Summary is the less expensive of the two. There is no other way to get your name on the title.

You have to file the will in the court where your father resided and go through probate. You will need an attorney to assist you. It likely will not be that expensive, depending upon the value of the estate. I have a post on probate basics on my website, www.floridawillmaker.com
