Legal Question in Landlord & Tenant Law in Florida
My fiancee' rents out rooms in our home. We have an irresponsible roommate that keeps a messy room, does not pay the full rent amount, and acts like he owns the place because he pays a little rent. He has gotten in arguments with everyone in our home. We are still debating his stay here because we need all the money we can get. But our roommate just decided to take off for a few days. I noticed a smell from his room (we live in a regular house- his door is next to our's and across from another roommate's room) and it seemed kind of warm outside the door. I knocked loudly, just to make sure he didn't come home early, and after several knocks and no answer I peeked into his room. I saw a pile of laundry ontop of our digital receiver box. With permission from my fiancee', the owner of the house, I entered and took the laundry off the box which was overheating greatly to the point of almost breaking. The laundry and box was extremely hot. It was a fire hazzard we thought we should take care of since he is out of state. I am just worried that my fiancee' will ask him not to do it again for safety's sake (and the box is our property) that he might get angry and say that we trespassed. Am I right to be worried or was it okay to protect our residence and other roommates?

Every landlord has the right to access the property - usually with notice to the tenant - however, in the event of peril there should be no problem. I suggest you file an eviction notice on this guy and get him out before he burns down the house.
