Legal Question in Landlord & Tenant Law in Florida
I have filed a claim in small claims court but the claim had the defendant surname misspelled. The sheriff has served the claim and a summons. Do I need to file an amended claim to correct the name or just wait until hearing date to submit a motion?

If the correct person was served you should be fine. If you amend your complaint then you will need to serve the defendant again.
