Legal Question in Landlord & Tenant Law in Florida
forecloser
Ive been living in an apartment for a yr n two months. I gave a deposit of 1,135. i re signed a yearly lease in july 08. 2 weeks ago someone came and gave me papers stating that the apatrment which i live in is in forecloser. I called the landlord and she told me that it was true. She stated that my lease was month to month and that she was sorry. Yesterday i found an apartment which i am interested to move in but that landlord said he needs someone by oct 1. I called my landlord and she said that i need to give her 30 day written notice or she will keep my deposit. Is this legal? Do i have to give her 30 day notice or can i move out since its in forecloser and we are in a month to month lease? i need my deposit back so i can rent as soon as possible! please help!!
