Legal Question in Landlord & Tenant Law in Florida
I had to formally evict my tenant because he would not pay the rent. My one year lease with him expired on March 31, 2009. The day before the Brevard County eviction hearing, he finally got out on July 2, 2009. He did not pay for the last three months of rent (April, May, June). Under Florida law, to sue him in Brevard County Florida small claims court, how quickly do I have to file suit ? How long can I wait ?

If it was a written lease you have 5 years to sue for breach. Four years to sue for breach of an oral breach.
