A friend begged to stay with us while she is looking for an apartment. From the kindness of our hearts, we allowed her to stay with us. We did not accept payment hoping that she finds a place to stay. It�s been more than 3 months and she is still with us. We were also told that we can not call the police or a shelter to intervene because she is accepting mails and letters in our home address, making her a �resident�, with or without lease agreement. We spoke to her and she said that she found a place and will move out on Oct. 12. We would like to make sure that she is moved out on Oct. 12.
If she can not move out on the said date, what actions can we do?

consider it a month to month tenancy and evict her.
You would have to file an ejectment action. I would try and get something from her in writing confirming that she is leaving on 10/12/12. If she does not move out you could terminate her tenancy then and an eviction could be filed which is much easier.
Either way, she is in your house so you need to be careful and mindful of what is going on.
