Legal Question in Landlord & Tenant Law in Florida
My friend and I put down a deposit to rent a house for the fall at the end of May. The Landlords kept twiddling their thumbs & never gave us any lease to sign. We contacted the landlords 2 weeks ago to let them know we were no longer interested in the property because we could not find roommates & we can not afford it on our own. The landlords refuse to give us our deposit back until they find someone else to rent it (& we don't know how long that will be). They even told me that if we took them to court it would not hold up -- however, I thought it was fraud to take someones money w/o anything in return & without any papers signed. So who is in the right??

You are right. YOu need to file a small claims action. If you are in Duval County, you can do this online. I don't know about the other courts but I have to guess they will allow it also. Ask for your filing fees, interest and time from your job as part of your settlement along with the sheriff fee to serve.
