Legal Question in Landlord & Tenant Law in Florida
my friends ex-boyfriend refuses to leave her house. She let him come to stay last month because he was on the streets and we where having record freezes so she allowed him to stay while it was cold. he has since refused to leave. She has pleaded several times and he contimues to not leave. she has not called the police. the reason she hasn't is last time they came out they said they could not make him and she is convinced they won't help her. This woman is broken and at her wits end but does not trust the police to do anything. what can she do?
1 Answer from Attorneys
She can change the locks, not answer her door, not answer her phone, call the police if he comes knocking and won't leave. He is trespassing, and once she tells him to leave, if he doesn't, the police will make him leave. If she claims that she called the police before, and they wouldn't make him leave, it is because she failed to make it clear that he is trespassing, and that she has ordered him to leave. Of course, this answer assumes that he isn't really on the lease, or paying part of the rent, or there because they have been living together for a long time. If he really is her "ex" she should not have let him in the first time. When a person comes up with excuses for not calling the police...that person doesn't really want to have the police deal with the problem. So, she needs to call an attorney instead, but only if she really really wants to get rid of the problem.
