Legal Question in Landlord & Tenant Law in Florida

I need information regarding eviction process in Ft. Lauderdale, FL. Tenants are late and per the lease, I am well within timeframe to move on an eviction. If tenant pays the outstanding balance, does the eviction process have to stop? What do I need to do to ensure outstanding balance for rent is paid if evicted?

You can evict for non payment of rent but you have to give the tenant the opportunity to cure the default by paying what is due. You can accept partial payments and still continue the eviction process. If your lease allows you to, you can terminate the lease and notify the tenant pursuant to the statute that the lease is ending. You can than sue to evict based on the termination of the lease. You cannot accept any payments since you are terminating the lease. Seek some legal guidance with your actual paperwork.

Start the eviction process per FS83. If they owe $ you sue for breach of contract.
