The contractual agreement may control if it is supported by legal consideration. Have an attorney review all your paperwork.

Can't give answer without having more info. Did writing amend lease...if there is a lease? Any eviction would require a three day notice to pay before the case could be filed. If you want to raise any defense to a law suit for eviction, you have to pay the monthly rent to the Clerk of court. If my office can be of any assitance, pls. give us a call. Tom Rosenblum
