Legal Question in Landlord & Tenant Law in Florida

My landlord failed to repair the patio in the back yard and I slipped and fell breaking my ankle. I gave him 2 weeks to make repairs or Ill move. He started eviction proceedings and I responded to the suit within 5 days. I had to pay into the court registry to be heard that this was an unlawful eviction and very retaliatory in nature because he also turned off the water. Court is on Monday and its Friday late afternoon and he just dismissed the case. Now he gets to keep my deposit with the registry? I never get a chance to be heard?

he does not get the money. you can petition the court and ask for return less processing fees. you did not file any claims so there was nothing to be heard from you side.if you wanted to pursue a retaliatory eviction matter you would have had to file appropriate claims.

since you fell , why have you not sue for personal injury. Since you told him of the danger on the property and he did not fix it, he is liable for the damages to you.
