Can a Landlord be fined or lose their property if their tenant is caught smoking marijuna in home?

Unless the landlord is participating in an illegal activity, they cannot be charged with a crime. Loss of the home would not occur unless it is confiscated for illegal activity being conducted. I suspect it would have to be more than pots smoking for this to occur.

However, there could be an issue if you are aware of the illegality occurring and you failed to notify the authorities.
