Landlord says we didn't pay the rent
My son's landlord says they haven't paid rent since they moved in (July). The have paid with personal checks and with money orders, and have the receipts for them. Landlord has gotten an attorney and they now have been mailed a letter with 3 days notice to pay the money owed. Also, when they have mailed the landlord personal checks he gets them no problem, but if they send money orders, he claims he never gets them and wants them to send more money. He has the rent sent to a friend or relative's house and not his place. (other partys address is the address stated in the lease).
My son wants to terminate the lease, that they just singed in July. He paid 1 months rent $1,400 and 1 month deposit $1,400. If he terminates the lease can he get his deposit back?
Also should he just let the landlord take him to court and present all his receipts and such to the judge and then countersue him for fraudulent eviction or whatever?
Look forward to your response and suggestions. My son cannot afford to get an attorney to fight this and is desparate.

I think it would be wise for your son to contact a lawyer. If he does not follow the correct procedures he could end up losing his security deposit. Feel free to contact my office to discuss the matter.
