Legal Question in Landlord & Tenant Law in Florida
Need help with landlord
Hello, and thank you for reading this. After living for two years in an apartment complex I opted not to renew my lease. I filled out the required form, and apparently everything was thought to be fine. But, a few weeks after moving out, I got a bill saying that I owed two months worth of rent because I didn't give sufficient notice to vacate (the penalty of not giving sufficient notice being that two months worth of rent). When I discussed this with the manager of the apartment office, he claimed that he had no such form, and that I owed them the two months worth of rent, despite that I had previously filled it out and given it to them. What can I do? Thank you.

You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. If you did not give your notice by certified mail then you will have no choice but to file suit against them if they have kept your security deposit to cover their alleged claim. Before doing so, review your lease and make sure that the notice is required. If it is, it will be up to you to prove that you gave the notice and for them to convince the court otherwise.
