Legal Question in Landlord & Tenant Law in Florida

my landlord retained my home rental deposit since Oct 2009 after agreeing to terminate my lease 1 month earlier for the amount of $2300.

since then I have hired a lawyer which told me based on my contract and the written agreement between the landlord and me I have the rights and would have a 95% chance of winning the case.

so I had the lawyer issue a letter (additional $500 cost) to the landlord, without feedback.

then I asked the lawyer to filed the claim in court (another $1000 cost to me).

But for the past 2 months I have not heard back or able to get in touch with my lawyer (after leaving numerous phone messages and e-mails) to find out about status / progress so I do not know if he's in deed filed my claim into court.

it has been 9 months now and after a total cost of $3700 I still have no idea when I'll be able to see settlement on my case. please help !!

First, check the county clerk of court's website to see if the lawsuit has been filed. You can search under court records for your name, since you would be the Plaintiff. If you had to file a complaint, it is a slow process. Usually a complaint is filed because the other side is denying liability and will not offer a settlement. Your attorney should have talked to you about this process and how long it takes. Your attorney has a duty to return your calls and communicate with you. Document your attempts to contact him and send a letter by certified mail. Go to the Florida Bar's website if you still get no response. You have a right to fire your attorney and hire a new one, but since this one's already been paid check your retainer agreement to see what you agreed to pay him if you do decide to fire him.
