Legal Question in Landlord & Tenant Law in Florida

landlord tenent foreclosure possible E&O case?

our land lord failed to pay his mortgage in turn our condo was foreclosed on we recived advice from a lawyer to not pay a dime to him. Soon after he became very hard to contact for not only us but the leasing agency. So we continued the non payment while looking for a new home we find one and set a move in date on aug. 1st 08. In the mean time he shut off our electric with NO notice to us or the leasing agency. Now he's persueing eviction. The lease itself mentioned nothing of foreclosure or the proper channels to deal with such a matter in turn which is possibly going to put us out a lot of money. what are my rights ? and how do I avoid loosing lots of $? due to his persuit of backed ''rent'' on his FORECLOSED condo. and isn't foreclosure a default on the landlord?

You need to meet with an attorney ASAP. You may have several defenses to an eviction action and could potentially avoid a judgment.

The fact that a property is being forclosed does not give you the right to stay there for free. You should have made the rent payments.
