Legal Question in Landlord & Tenant Law in Florida

Can Landlord Turn Off Water?

We are half a week behind in rent, and we just received a letter stating that the water will be shut off if we do not pay in 24 hours, and that we will be required to vacate the premises withing 72 hours. Can they shut off the water before we are vacated? The remainder of the rent will be payed tomorrow when I get paid, so I'm not worried about it, just wondering if it is legal. I'm in Florida. Thanks!

Re: Can Landlord Turn Off Water?

Your landlord cannot turn off the water for non payment of rent. That is what is called a constructive eviction. If he wants to evict you for non-payment, he can, but he must do it legally, through the court system.
