Lease ended tenant won't leave

1 year lease (1st last and 500 security deposit collected at begining of lease),ended June 30. Tenant advised many times he wanted to renew and stay at least 3 years. June 1st we gave tenant copy of new lease and advised we would meet to sign it on July 1st when he paid July rent. We heard nothing. We left messages on 4th and finally heard from him on the 6th. We went over on 9th to collect July rent and give him the lease which he had already signed. He advised he didn't have the rent money, (he's been late at least 8 or 9 months out of the last 12 with his rent). We told him he was now living on his last months rent and that he has to be out by the end of July. Question is how do we go about getting him out? Since there is no lease now, do we have to do a legal eviction? How long will that take as we need to get it rented and to do that must be able to show it. Do we need an attorney for this?

1. You must bring a legal eviction action immediately.

You are now on a month to month tenancy. You need to give him 30days written notice and make sure its certified return receipt. If he does not leave once the 30days expires then you need to start the eviction process. My firm handles landlord tenant.
