Legal Question in Landlord & Tenant Law in Florida

I live in an apartment complex and recently there have been black bears roaming the complex and eating our garbage. There are times that I can't even leave my apartment because there is a bear outside my door, and I am always fearful when I come home at night. Do I have a right to break my lease because it is uninhabitable?

This is a legitimate concern, and I agree that black bears roaming the grounds makes your unit unihabitable due to health, safety and welfare concerns. Give reasonable notice, telling the landlord about the bears, and take notes about the number of bears, locations, times, take photos, call the police or animal control, get reports on record, etc. so that you can prove your case if the landlord decides to sue you for lost rent. The landlord should either fence the complex, secure the garbage off site, or take other action to prevent these midnight mischief makers that can be very dangerous.
