Legal Question in Landlord & Tenant Law in Florida

mold growing in house

We have mold growing in our apartment. Both the tile in my kitchen and bathroom are discolored. Our place was flooded two or three years ago and I know the back two bedrooms have mold under the rug. Since living here for the past few years we have had an increase in health problems. My 22 month old has problems with allergies and she recently had bilateral pneumonia. My other kids have colds and sinus infections a lot, one of them has headaches all the time, and I have bronchitis every 6 months. We never had this much sickness before this period. My landlords are aware of this problem. They told my husband and I to bleach the tile and just spray lysol on the rug. How can I find out if it is toxic mold and if it is causing the problem? If this is the source of the situation, how can I get my landlords to change the tile and rugs?

Toxic mold can be a serious problem. In order to link the mold with the health issues experienced, you need to have a mold inspection conducted by a mold inspection company and then have the findings reviewed by a physician who then can determine whether a correlation exists. I concur with Mr. Pollock. You need to have your apartment inspected by a certified mold inspector. You may want to do this at your own expense rather than having your landlord retain someone that may be dishonest or may destroy material that is essential evidence of the mold exposure. After you have obtained the mold report, seek advice from a personal injury attorney.
