Legal Question in Landlord & Tenant Law in Florida

Mold in home

After a tropical storm hit florida a few weeks ago, we had minor water damage to the back wall of the house. Now there is mold growing in that wall? The landlord won't release us from our lease what can we do?

Re: Mold in home

If the condition is creating a hazardous environment, then you should notify the landlord in writing of the condition and ask them to remedy the problem.

Contrary to popular "wisdom" not all mold is hazardous. Despite this, your landlord should have the mold inspected and removed if necessary.

You are afforded rights under Florida law which can allow you to terminate your lease if your landlord refuses to cure a situation which is hazardous. You must notify him in writing, send it certified, then give him time to "cure", usually 90 days.
