Legal Question in Landlord & Tenant Law in Florida
Last Month Rent
When I moved into my apt 6 years ago, I paid first, last and a securty deposit. Now that I am moving they want me to pay them $140 to make up the difference on the last month rent due to the increases thru the years. Can they do this?

Yes. If the rent increased over the years, they have a right to collect the difference. It is certainly not worth a legal battle for the amount in question. Make sure you receive interest for each year they have held your security deposit, however. This is provided for by Florida law unless the landlord informed you that your security deposit was being held in a non interest bearing account and the name of the institution where it was being held.

Probably not, unless increases are spelled out in your lease. If they do not refund your security deposit, or properly notice you of their legitimate withholdings, contact an attorney to bring an action to recover.
