Legal Question in Landlord & Tenant Law in Florida

I moved out of my apartment because of problems with mice. They sent out pest control a number of times yet the problem still was still there. Now they want me to pay fees for breaking the lease. Do I have to pay them. And do I need to go to court to prevent them from putting it on my credit report?

If the property is uninhabitable due to mice infestation, you have the right to break the lease. However, you landlord will likely sue you so be prepared to tell the court your reason, and have proof to back up your story. Records of the pest control, photos of mouse damage, witnesses who will testify, etc. Whatever happens in court will determine whether or not the landlord would be justified in reporting this to credit reporting. You can always challenge that report, or require the credit reporting companies to also show your explanation of the conflict.
