Legal Question in Landlord & Tenant Law in Florida

I have a neighbor that has very loud parties overnight (from 9PM to 6 or 7 AM), on most weekends and even on weekdays. This is a residential neighborhood. I am not the only neighbor unhappy with this activity but I am the most affected since my house is 2ft off the property line. They have already been arrested for voilating the noise ordinace/public nuisance laws for the city of Tampa. I can't sleep in my own house. I am having to spend money on new windows for the bedrooms so the double-pane glass can quiet some of the noise. I am considering foam insulation in the walls for the same reason. I own. They rent. Do I have any legal recourse against them or the landlord (loss of use?)

That is simply unacceptable. First off, call the police each and every time there is a violation of local ordinances.

As far as civil remedies, you are entitled to "quiet enjoyment" of your property. You can sue to enjoin the activity on the property and potentially for damages. You should keep every receipt for work that you've performed to soundproof your house to prove your monetary damages. The landlord has a responsibility to ensure that the tenants comply with local ordinances, so you should definitely put the landlord on notice of your claims.

I suggest that you speak with a local attorney who handles general civil litigation and real property law.
