Legal Question in Landlord & Tenant Law in Florida
My niece who rest a room me by verbal agreement pays rent of 60.00 a week. She always late with the rent. Now it's 4 days past due and she says she's moving out and refuses to pay what's owed up to this point. She came to get her things which I refused to let her do until she gives me the 94.00 that's owed. Am I legal in my actions?

Not really. You don't have a right to keep her possessions as collateral for the rent. If she doesn't pay the rent, you can sue her for it.

You dont have a right to hold her items hostage. You can certainly pursue your rights to collect the rental if you want, but the costs will be more than she owes.
