I recently entered a lease/option agreement with a home owner. I contacted them several times last week stating that I would have to make my payment late due to an accident that left me uabale to work for a week. As a self-employed drywall contractor this means no income....I realize that this in not the fault of the landlord but I gave them $5000 for a down payment on the property in March with the option to purchase at the end of the year. The payment in now today 3 days late, and we were served on Saturday a notice to vacate in 3 days (June 7th). I told them I would gladly pay on the 9th and even start paying extra so this problem wouldn't happen again. I also notified them of an a/c issue, as the drywall is crumbling in my son's room around the a/c duct due to moisture. We did just recieve a $482 electric bill for a 1500 s/f home. When we went into the attic we noticed substantial moisture on the drywall ceilings and a trunk line off the unit. This is what the LL responded to us, ''NO PAY! NO STAY! RESPONSIBLE FOR MAINTENANCE! READ LEASE AND FIX IT!'' Are we responsible for all maintenace and can he evitt us Thursday as he stated?

Florida law seems to allow for a landlord to post the notice and then follow statutory guidelines in order to evict a tenant. On teh expiration fo the 3 day notice, the landlord does not necessarily have the right to throw you out and change the locks. I may be able to help, but would need more facts.
