Legal Question in Landlord & Tenant Law in Florida
I was just notified that my Landlord was served with foreclosure papers on the residence which I rent from her. What are my rights and should I keep paying rent despite the fact I ill probably need the money to secure new residence if this property is foreclosed.

You have the right to continue under your lease. Once the property is foreclosed, you have additional rights under new federal laws to at least 90 days notice prior to a requirement to vacate and a possibility of being able to stay there for the remainder of the lease term, depending on the particular circumstances. Please meet with an attorney for more specific advice.
You must continue to pay your rent to your present landlord or she can evict you for nonpayment of rent. The property is still hers until it is foreclosed on, and the bank takes it over. Then, they have to give you the 90 days notice.
Yes, you must continue to pay rent or your landlord can evict you for failure to pay. Foreclosure is a long process, especially if your landlord is defending himself or trying to work out options with the bank. Communicate with your landlord, and if you are not given 90 days notice and you have a valid lease, then contact an attorney. Regards,
