Can the owner of a house remove someone out of the house without a written lease or any formal agreement?

My father recently kicked out my older brother from the house. My brother had been living in our home since the end of November 2009. He did not pay rent or any utility bills. He was given all of the basic necessities, including food, water, etc. Due to disagreements, my father demanded that he leave our home. According to a police officer who had arrived at the scene, since he had been living in our home for over six months, he would have to be formally evicted. Is this valid, given the fact that there were no formal agreements?

YOu do not state how old this man is. If he was allowed to live there as a tenant, then you would have to file formal eviction notice. Need more info.

Since he first entered the premises legally, you will have to evict.
