Legal Question in Landlord & Tenant Law in Florida

parking lot responsibility

What is the responsibility of an apartment complex as far as the parking lot is concerned? My car was broken into and suffered almost $1000. worth of damage. The manager say they are not responsibile. Is that a fact? I would not be parking here if I did not live here.

Re: parking lot responsibility

They are not responsible in the absence of some negligence. The fact that they own the lot is not enough.

Re: parking lot responsibility

Apartment complexes have limited liability with regard to incidents in the parking lot. There are factors which could increase their liability such as creating an unsafe environment, or ignoring a defect which creates an unsafe environment.

Generally, they have no liability regarding vehicle break ins. The damage to your car is covered by your auto policy provided you carry the proper coverage. Any contents should be covered by your renters insurance policy.
