Legal Question in Landlord & Tenant Law in Florida
do I have to pay for extermantion of the Apartment,it does not say in the contract
1 Answer from Attorneys
Your landlord should pay to keep the property free of roaches, etc, but you will have to do your part by keeping your unit clean. Send your landlord a request for insect spraying, and if the landlord fails to do this, you can have your own unit sprayed. (it's better to spray the entire building, as bugs will still come in from other units) You can then deduct the cost from your rent. If the landlord decides to take legal action against you, claiming that you are unlawfully witholding rent, be prepared to demonstrate the need for the spraying, with evidence. (bugs in bags, photos of bugs, written statements of other tenants, etc). Your argument will be that the bugs were bad enough to impact the "habitability" of the property.
