pet deposit

I moved into my apt in Sept of 2004. When I moved in the property, it was owned by a reality company. They had no problem with my dog and did not make me pay a pet deposit. About two months later the property was sold and a new owner came in. He mentioned a pet deposit once but did not enforce it. Now in Nov 06, he is demanding that I pay a $250 pet deposit for her by the end of the month. Is this legal? Do I have to pay it now, after all this time?
