Do I have to place the landlord on notice that he is in violation of s.83.51?

The lease should contain notice procedures for notifying the landlord of the conditions on the premesis which need to be repaired. If you do not notify the landlord of a condition on the premesis, you as the tenant may have failed to comply with your obligations to maintain the dwelling unit (FS 83.52). Additionally, if you claim any right to withhold rent, you must notify the landlord in compliance with FS 83.60.
