Question: Is the landlord responsible for the $3500 estimated damages to my car after a tree on his property fell on the vehicle? If not, to whom do the responsibility lie?
Background: On Saturday, January 16, 2010, a tree on the property, which I have been leasing for 26-days, fell on and damage my car. I telephoned my auto insurance company which said that the responsibility for damage is with the landlord. If I file a claim, it would raise my insurance rate. The company would get their reimbursement for the landlord's insurance company; if not, they would sue him for restitution.
I believe that the responsibility is to the landlord for damages caused to my car. I called Consumer Protect Services and they said to send him the 3-repair estimates which average $3500.
