Legal Question in Landlord & Tenant Law in Florida
I recently reserved an apartment and gave the apartment management an application and administrative fee. They sent me a welcome packet with my new apartment number and all my move-in information. At that time, I gave 60 days notice at my current apartment. 3 weeks later, the new apartments called me to tell me that the current tenants decided not to move and that I could not have the apartment. They offered to move me into other apartments in a different building with a different floorplan, but I do not like those. The whole reason I chose this apartment was because they had one on the top floor available in the floorplan that I like. Now I have to be out of my current apartment within 45 days and I have no new place lined up. What should I do?

Did you sign a lease with the new landlord for that particular unit? If so, you may have recourse. If not, your best option may be to play this situation to your negotiating advantage and obtain a reduction in rent at the less favorable unit or other concessions from your landlord.
