Legal Question in Landlord & Tenant Law in Florida

Being released from a lease

I leased an apartment with a roommate. When I chose to leave, he agreed to sign me off of the lease. Unfortunately, I could not stay to make sure it was done. Needless to say he did not sign me off and he has another roommate living there already. What steps can I take to remove my name from the lease without his signature?

Re: Being released from a lease

Your former roommate has no authority to release you from your lease. Only the Landlord can do that.

That said, as long as your friend and his new roommate have been paying their rent on time, i see no reason why the landlord would not release you, but you would need his consent. You should contact the landlord or you may find an attorney who can help you with this process. What you should request is a rlease from the landlord saying you are no longer obligated under the lease.
