You need to demand the money back if she is not willing to deliver possession of the premises. A lease agreement is not required, and you paid money in exchange for her promise to rent you the place starting 10/1. If she was unsure about it, she should not have taken your money. If she does not give it back to you, and you (at least) have proof of the amount you paid by check, consider taking her to court.
