Our rent has been late and we have a 10 day grace period. Our landlord states that he can get an lawyer involved. My question is can he sue us if we are paying our rent even though it is late and we have $100 late fee. can he evict us and if we do not pay how long would an eviction take?

As long as he cashes your check with the late fee in it, he can't evict you. If you don't give him the money by the lease's late day, he can post the three-day notice on your door. Then he can file the eviction, and you have five days from being served to answer the eviction complaint and give the rent and late fees to the clerk. If you don't answer and give the rent and late fees to the clerk, the sheriff will throw you out in 48 hours or more, depending how busy they are.
