Legal Question in Landlord & Tenant Law in Florida
rental property/foreclosure
I am renting a home which was recently served with a foreclosure notice and I have been informed to not make any payments to my landlord until he clears up the foreclosure. He informed me that he is not going to do anything about the foreclosure until the mortgage company drops the price. I was told that he can not evict me for not paying rent while the house is in foreclosure. Is this correct? Ocala, FL

no

He can evict you while the house is in foreclosure but there are ways to handle the situation so you are not paying full rent to him during this process because he is in breach of the lease for allowing the property to be in foreclosure. Should you have any questions, feel free to give me a call.
