Legal Question in Landlord & Tenant Law in Florida

I rented a one bedroom unit in the Sunny Isles Beach area in August of 2010. I signed my lease on 8/1/2010 and it was due to end on 10/31/2011. I put down a two month deposit of $2,680. I moved out on 09/30/2011 because they had sent me a letter asking me to either sign a new lease or find a new apartment. I choose to move out and dropped off a letter at the administration office saying that I would be moving out. A couple of weeks later I got a call from administration in september asking me to schedule an inspection as soon as possible. My understanding was that I had to leave in September. Unfortunately my lease contract was not in my possession at the time, so I failed to double check my move out date. After moving out, I was told to expect my security deposit check back within the next two weeks, instead I got a bill which included, rent for the month of October ($1,340), a promotional discount ($5025), carpet replacement ($186), hole in tub ($180). A total of $6731.00. Off of this amount they discounted the security and key deposit ($2755.00). Which means they're asking me to pay $3976.00. It's been over a year, my attempts to contact that have usually failed, they tell me that they can't find my file, other times they've told me that I need to pay it off, but they don't offer me any flexibility. I haven't heard from them or any credit unions so far. Obviously I want my security deposit back. Is there some way to get this back? Can I just pay the month of October? Please help.

Thank you.

since they asked you to leave, you did not break the lease. as to the damage, they had 15 days to send you an itemized statements as to what was damaged and the costs. Send them a letter (certified of course) and ask for your deposit. Give them 10 days to comply - if they do not take them to small claims.
