Legal Question in Landlord & Tenant Law in Florida

I rented a house in Florida and never sighned a lease. I sent a rent deposit for the house stating I would need it for January - April. I called the landlord on March 15 and said we would not be able to stay the month of April because my husband lost his job, and we needed to move. Is the landlord allowed to hold my deposit. He has never returned it saying that he is using it as the month of April rent that we didn't use. I left the house in IMMACULATE condition, video taped everything, neighbor came over and on video stated the house was IMMACULATE and everything looked great. The landlord then told my husband we WERE NOT getting our deposit back that was $1500!! Is he able to keep that?

If the landlord was not able to rent the house during the month of April then yes he could use the deposit for the rent. Was the rent the same as the deposit. If not, then he owes you the difference.
