We have a renter that we want to move and we can't afford eviction right now...can we enter the home legally without them there? they will not let us in...

You can enter the home at a reasonable time and with a good reason, such as to inspect the place to see how it is being treated or to make a repair. There is no requirment that your tenant be present at the time you enter. Also, your tenant cannot prevent you from entering at any reasonable time. You are not required to give notice, either.
