Legal Question in Landlord & Tenant Law in Florida
renters rights
Channel 35 in Orlando just did a spot on renters who are getting evicted due to the foreclosure of the owners from their lack of mtg. payment. They went on to say that the renters were just out of luck and couldn't do anything. Isn't there some consideration for them under the 83 Fl Statuate? My owner is being foreclosed on but is still demanding my rent money...which I have faithfully paid the past 11 months...and yet he hasn't paid his mtg. for the last six months! Can I withhold my rent from him? I did send him a letter giving him notice to rectify the situation in seven days or I would stop paying him at that time.

Re: renters rights
You owe rent for the time you are living there. Pay the rent into court, if you do not feel comfortable giving it to the owner. Until a court signs a judgment of foreclosure, the owner is still entitled to rent. You should appear in the foreclosure action I try to delay it until your lease expires.
