Legal Question in Landlord & Tenant Law in Florida
Roommate smoking weed in apartment
My mother is the guarantor on an 2 bedroom, 2 bathroom apartment, in which myself and one other college student live in. Since I've lived here, my roommate has smoked weed. At first I tried to let this go but was always antsy that something might happen and I would go down with her. Now she has this boyfriend who I'm sure is involved in drugs too (he's 27, doesn't have a job, but drives brand new expensive cars and motorcycles) and she's been smoking weed IN her room instead of on the patio now. She's making living her very difficult and refuses to move out when my mom saw that she was smoking in the room. Legally can my mom kick her out? or, can I tell the apartment complex what is going on without having the entire lease terminated?

Re: Roommate smoking weed in apartment
You left out the most important piece of information . . . . who signed the lease. You mom didn't if she is only the guarantor. That means she has no rights; she just has to pay if someone does not. If you are on the lease and roommate is not, then you can kick her out. If you are both on the lease, then you are out of luck, but you might get some help from the landlord.
