Legal Question in Landlord & Tenant Law in Florida
Smoking issue, have complained verbally and in writing, kept copious notes. I have lived here for 4 1/2 years, Beachside Ormond Beach. The guy downstairs says he's not smoking inside and the owner finds it sufficient to take his word for it and basically says it's my problem even though what this guy is doing is against the law. I live in a VERY safe and secure area and don't believe I should have to move to a less safe and secure area because the owner refuses to do anything. Am I in the right, or no? Thanks

Does the lease state no smoking? If his lease does not then there is no much you can do . Now if he is breaking a law - is this dealing with drugs.? Does he have a prescription for medical marajuana ?
