Legal Question in Landlord & Tenant Law in Florida
My son and I were wrongfully evicted with no 30 day notice, or notice of any kind. When we protested and they tried to break in (there were appx. 8 people banging on doors, trying to break in since we did not answer door), I called 911. When the police arrived, the people who were trying to break in gave the police untrue allegations, and my son and I were arrested. the next day, after being released, we returned to house to find that these people had moved in, and had thrown all of my property in the garage, driveway. I have lived in this home for 9 months, all utitilities and bills are in my name, and my cars, animals are all still there, as there has been a temp. restraining order placed against me. I am astounded that the police even got involved, and did not even bother to look at all the mail in my name, etc.. I have had 2 family members attempt to go and get some things, but they are being run off and told they will be hurt. The Manatee co. Sheriff Dept refuses to give us a escort. I am homeless, and now have my personal property being held by these people.
we need legal advice.
thank you,
Donna Christ

Do you have a lease agreement. If you do, then take that to the police station. Tell them that you wish to remove your items. Do these people even have a lease with the landlord. Have you talked to the landlord. There is a lot you have not said. I can't imagine you not being able to retrieve your property.
