Legal Question in Landlord & Tenant Law in Florida

Split Apartment Lease

This issue is regarding a split

apartment lease. Both of us are

students at the same institution - a

private institution that gives

students the opportunity to study

abroad. Upon my notification of being

able to study abroad, my roommate

and I had came to the agreement

that his friend (also a student) would

move into my room and sign over

my part of the lease. I moved out

and the new roommate moved in

the following day. After several

weeks of both of them saying they

would take care of the lease papers,

it was time for me to move over seas

for school. After notifying his mother

of the situation, everything has gone

downhill. He has threatened to say

that I moved out without him

knowing & even paid to get the locks

changed. About a month and a half

has passed, and both will not sign

over the papers to take me off the

lease, yet they pay for rent on time.

The leasing office says there is

nothing they can do about it,

because the rent is being paid on

time and they cannot verify that

someone else is living in my room.

The lease is over in December.

You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

You did not pose a question but I am sure you are concerned about your potential liability. At this point, there is not much you can do except hope that the subtenant and your former roommate continue to pay the rent on time and that there is no problem with your lease. Your only other option would be to move back in which would prove difficult if you are now or soon to be overseas.
