Legal Question in Landlord & Tenant Law in Florida

Stopped payment on a check

My tenant gave me a check for damages to my newly furnished condo. She ruined my couch, chair and rugs, bedspread and misc other things before I formally evicted her. The security money does not cover all the damages and she was willing to write me a check for the difference. She then stopped payment on the check and moved to Texas. I understand that small claims court will not be easy now that she has moved out of the state.

Is it illegal to stop payment

on a check in Florida?

Thank you in advance for any comments or suggestions that you might have.

Re: Stopped payment on a check

You can file a small claims action here in Florida and have her served in Texas. It would be wise to contact a lawyer. Should you have any questions please contact my office.
