Legal Question in Landlord & Tenant Law in Florida

Sublease / contract breach

Ok I moved into a 2 bedroom with a gentleman who was already on a lease. He wrote a contract that said I have to give 30 days notice before moving out. The apartment complex does NOT allow subleasing, but can he still take me to court for breaching an un-notorized contract he wrote himself?

You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. If you do not agree, then stop right here, and do not read any further.

Probably. A court would most likely allow an agreement between you and the gentleman if both parties agreed to it. It would be up to the apartment to complain about an unauthorized sublease but they are not a party to the transaction or the litigation.
