Legal Question in Landlord & Tenant Law in Florida
I have a tenant who seems to have abandoned his apartment. He was behind on his rent and I delivered a three day notice. I got no response. I filed for eviction and the 5-day summons was posted and mailed to him. He has not responded. Tonight I called him to ask if he has vacated the apartment and he hung up on me. There are no clothes or personal belongings--toiletries, etc.--in the apartment, but he left two love seats and a bed and two pillows. Do I need to proceed with the eviction process, or can I assume he has abandoned the place and proceed to get it cleaned up and rent it?

if he does not answer the summons, then proceed with the eviction.
