Tenant above me caused damage to my property

The tenant that lives above me left the hose running into his fishtank on the fourth of july and decided to leave his apartment.When I arrive to my house that night I find my apartment flooded and water coming down the walls.I run upstairs and nobody was home.He returns about an hour after I had already begun cleaning the mess.I asked him to not let it happen again.Well I was on vacation last week and it just happened that I lest my mother inlaw watching over my place.She called me wed. to inform me that when she woke up the apartment was flooded and that water was coming down thw walls.Now I arrive back in town Monday to find that I now have green mold growing on my walls and damage to my property.I showed the tenant from upstairs and he says he can't do anything about it.I asked for the phone number to the owner of the apartment and did not give it to me.What are my rights? And what can I do? Can anything be done? What measures can be taken against him or the owner for such negligance?

1. Advise Landlord, in writing as to what is happening.

2. Sue tenant for your proveable money damages.
